Summary
JD E-Commerce America Limited (Joybuy Express) is recalling all Marainbow Portable Infant Safe Seat and materially similar child seats. Please refer to Joybuy Express’ affected products attachment for specific child seat model details. The installation labels display incorrect instructions. The child seat’s design also prohibits it from being installed properly. As such, these child seats fail to comply with the requirements of Federal Motor Vehicle Safety Standard number 213, “Child Restraint Systems.”
Remedy
Joybuy Express will provide a refund to purchasers. Owner notification letters were mailed February 21, 2023. Owners may contact Joybuy Express’ customer service at 1-302-426-4543 or overseas-service@jd.com. This recall expands and replaces NHTSA recall number 22C-007.

Dear Joybuy Customer,
This notice is sent to you in accordance with the requirements of the National Traffic and Motor Vehicle Safety Act. JD E-Commerce America Limited (“Joybuy Express”) has decided that certain child seats (see list below for specific models) fail to conform to Federal Motor Vehicle Safety Standard No. 213, “Child Restraint Systems.” According to our records, your child restraint system is affected.
Affected products include the following products sold on the Walmart marketplace:

- Portable Baby Infant Safe Seat Kids Car Seat,
- Thickened Portable Safety Car Seat for Children Aged 0-6,

These child restraint systems may fail to meet certain labeling, instructions, registration form, and manufacturer filing requirements, and their design may prohibit proper installation.
As a result, the child seat may be improperly installed, increasing the risk of injury in a crash.
Joybuy Express is advising all purchasers to dispose of the child restraint system by cutting the straps off to prevent the car seat from being used. Joybuy Express will refund the purchase price to our customers. If you wish to receive a refund, you must send visual proof of the destruction of the car seat, such as photographs or a short video, to the following email oversea-service@jd.com. Please include your order number, name and address when submitting your refund request.

You are required to submit a draft owner notification letter to this office no less than five days prior to mailing it to the customers. Also, copies of all notices, bulletins, dealer notifications, and other communications that relate to this recall, including a copy of the final owner notification letter and any subsequent owner follow-up notification letter(s), are required to be submitted to this office no later than 5 days after they are originally sent (if they are sent to more than one manufacturer, distributor, dealer, or purchaser/owner).
Under 49 U.S.C. § 30112(a), it is illegal for anyone, including a manufacturer, distributor, dealer, or retailer to sell an item of equipment or vehicle that fails to comply with all applicable Federal motor vehicle safety standards.
As stated in Part 573.7, submission of the first of eight consecutive quarterly status reports is required within one month after the close of the calendar quarter in which notification to purchasers occurs. Therefore, the first quarterly report will be due on, or before, 30 days after the close of the calendar quarter.
Chronology :
JD E-Commerce America Limited (“Joybuy Express”) received a cease and desist letter from NHTSA on May 3, 2022. On May 16, 2022, Joybuy Express confirmed that it ceased offers for sale in the United States of the products identified in NHTSA letter. On July 1, 2022, Joybuy Express agreed to conduct a voluntary recall. On December 29, 2022, Joybuy Express submitted a 573 Report to officially begin carrying out Recall No. 22C008.

According to a letter dated December 1, 2020 (as attached), the National Highway Traffic Safety Administration (“NHTSA”) determined that the Marainbow Portable Infant Safe Seat child restraint system contains deficiencies which constitute possible noncompliance with Federal Motor Vehicle Safety Standards. Out of an abundance of caution, Joybuy has agreed to proceed with a voluntary recall of the Marainbow Portable Infant Safe Seat, as well as all materially similar products. Provided that Walmart is the sole distributor of these products in the United States, Joybuy intends to work in conjunction with Walmart to promptly notify customers of the possible noncompliance. As part of this recall effort, Joybuy will offer a full refund to all purchasers upon receipt of proof of destruction of the item. More information about this recall can be found in the attached Part 573 Safety Recall Report. We look forward to discussing this recall matter with Walmart team during our meeting today.

Description of the Safety Risk : The noted noncompliance does not affect the dynamic performance of the
child restraints but the products may not have the required labeling as specified in S5.5, printed instructions as required by S5.6 or the product registration card as required by S5.8. The failure to provide the required information could result in caregivers using the CRS inappropriately and the failure to provide a mechanism for customers to register the CRS with a manufacturer increases the difficulty of locating customers in the event of a recall. Further, these child restraint systems were designed to be attached to the back and/or cushion which fails the requirements listed in S5.3.1(a). The CRS also lacks the ability to be installed using the methods required by S5.3.2 & S5.9 for a CRS of this type. Failure to comply with these safety standards may result in improper installation and increase the risk of injury.
