Three of these tires were returned from a dealer which made CTA aware of the noncompliance, leaving three tires unaccounted for in the market. Production Dates : MAR 08, 2020 – MAR 14, 2020 TIN (Tire Identification Number) Plant ID Size code Optional Code Begin M Code End M Code 036 0F 934V 1020 1020 Description of Noncompliance : Description of the Noncompliance : The noncompliance is due to a mold error in which the subject tires contain a tire identification number (TIN) that omits the 3-digit plant code as well as the 6 symbol manufacturer’s identification mark as required by paragraph S5.5.1 (b) of FMVSS No. 139 and 49 CFR 574.5(b). Specifically, the tires should have been labeled as “DOT 036 0F934V 1020” on the outboard sidewall and “DOT 036 0F934V” on the inboard sidewall. Instead, the tires were incorrectly labeled as “DOT 1020” on the outboard sidewall and “DOT” on the inboard sidewall. FMVSS 1 : 574 – Tire Identification & Recordkeeping FMVSS 2 : NR Description of the Safety Risk : Without a TIN on either sidewall, there is no means by which purchasers can register the subject tires. Description of the Cause : The 3 recalled tires were pre-serial production tires not intended for sale to the public. Identification of Any Warning that can Occur : NA Involved Components : Component Name : NR Component Description : NR Component Part Number : NR Supplier Identification : Component Manufacturer Name : NR Address : NR NR Country : NR Chronology : 01/07/2021: CTA was made aware of a field complaint for three (3) tires with missing tire identification numbers (TIN) 01/07/2021 – 04/13/2021: CTA immediately issued a quality hold and sorting action on all remaining inventory of this tire SKU. An internal investigation was initiated to determine the root cause and to determine if other noncompliant tires may have been sold into the market. The investigation revealed that the tires were produced as pre-serial production in the Rayong, Thailand manufacturing plant. A total of six tires were shipped to the USA and sold, three have been returned, three are believed to be in the market. 04/14/2021: CTA’s Product Integrity Committee convened. A decision was made that the three (3) remaining tires with the noncompliance must be reported to the NHTSA. 04/20/2021: CTA submitted a Noncompliance Information Report to the NHTSA 05/13/2021: CTA submitted a petition seeking exemption from the notice and remedy requirements of the Motor Vehicle Safety Act, pursuant to 49 U.S.C. § 30118(d) and § 30120(h) and 49 CFR Part 556, on the basis that the noncompliance is inconsequential to motor vehicle safety. 02/10/2023: NHTSA advised CTA that the inconsequential petition from 05/13/2021 was denied and therefore CTA is submitting this 573 notification. Part 573 Safety Recall Report 23T-001 Page 3 The information contained in this report was submitted pursuant to 49 CFR §573 Description of Remedy : Description of Remedy Program : CTA will conduct a safety recall campaign to replace the subject tires that have been sold as replacement tires or are in dealer inventories. All potentially affected customers, distributors, dealers and independent outlets will receive notification of the campaign, instructions on how to identify the subject tires, information regarding removal of the subject tires from service, and instructions on the return/disposal of affected tires. CTA will offer to reimburse the replacement cost for any customer who, prior to this campaign, replaced these tires due to the condition described above. How Remedy Component Differs from Recalled Component : Remedy tires are from DOT weeks other than DOT week code 1020. Identify How/When Recall Condition was Corrected in Production : The affected noncompliant tires were produced in a pre-serial production run in March, 2020 and were not intended to be sold. Serial production with the full DOT TIN sidewall information was started in August, 2020. Recall Schedule : Description of Recall Schedule : CTA will notify distributors, as well as all independent outlets to replace the tires that are the subject of this recall, of their responsibilities in accordance with Section 573.6(c)(9). Distributors and outlets will be instructed to return affected tires to CTA for disposal.
