Daimler Trucks
North America LLC (DTNA) is recalling certain 2011-2021 Thomas Built Saf-T Liner HDX school buses. The forward seat barriers may not provide sufficient protection to passengers. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard (FMVSS) number 222, “School Bus Passenger Seating and Crash Protection.”
Remedy
The remedy is currently under development. Interim notification letters, notifying owners of the safety risk, were mailed November 8, 2022. A second notice will be sent once the final remedy is available, anticipated late September 2023. Owners may contact DTNA customer service at 1-800-547-0712. DTNA’s number for this recall is FL843. This recall replaces NHTSA recall 19V899.

Basis for Determination of the Recall Population: All HDX school buses built with wall mounted barrier at the first rafter on passenger side after -10/21/2009, when FMVSS 571.222 changed school bus barrier requirements.
Chronology :
October 30, 2019, NHTSA notified DTNA of potential noncompliance with FMVSS 222, S5.2.3: Barrier performance forward relating to certain barriers equipped on the Saf-T-Liner HDX School Buses. Based on the information provided by NHTSAโs testing, DTNA began to investigate the issue to evaluate the potential noncompliance and to determine the scope and establish the potentially affected population. November 2019 DTNA requested a visit to NHTSAโs test facility to review findings. On December 11, 2019, DTNA visited the NHTSA test facility to review test procedure and findings with NHTSA. On December 17, 2019, DTNA determined that a non-compliance exists on certain vehicles built with the suspect barrier mounted at the 1st rafter on the passenger side. The issue was that a purely aesthetic piece of foam changed the technicalities of how structural testing is performed, resulting in barrier with the foam not passing the amended FMVSS 222, S5.2.3 requirement. On January 16, 2020, DTNA submitted a petition seeking exemption from the notification and remedy requirements of 49 U.S.C. 30118 (d) and 49 C.F.R. Part 556 on the basis that a noncompliance with FMVSS 222 is inconsequential as it relates to motor vehicle safety. On or about August 4, 2022, DTNA received notice from NHTSA that petition was not approved. On August 10 2022, DTNA filed the amended DIR to begin the process of recalling those Barriers upon receiving the notification of NHTSAโs determination regarding the petition. I mid-August 2022, DTNA refiled this recall at the request of the agency. It will supersede 19V899

Daimler Truck North America LLC, on behalf of its wholly owned subsidiary, Thomas Built Buses, Inc., has decided that certain Model Year 2011-2021 Thomas Built Buses Saf-T-Liner HDX model vehicles manufactured October 21, 2009, through November 12, 2019, fail to conform to Federal Motor Vehicle Safety Standard No. 222, โSchool Bus Passenger Seating and Crash Protection.โ In the event of a crash, occupants may collide with the front seat barriers with more force than intended, increasing the risk of injury. Daimler Truck North America LLC, on behalf of its wholly owned subsidiary, Thomas Built Buses, Inc., has decided that certain Model Year 2011-2021 Thomas Built Buses Saf-T-Liner HDX model vehicles manufactured October 21, 2009, through December 16, 2019, fail to conform to Federal Motor Vehicle Safety Standard No. 222, โSchool Bus Passenger Seating and Crash Protection.โ In the event of a crash, occupants may collide with the front seat barriers with more force than intended, increasing the risk of injury. This is the first of two notices you will receive regarding this subject. This letter is to inform you of an upcoming Recall to correct the issue noted above. The repair is being validated and parts are being procured. You may continue to operate your vehicle. The second notice will inform you when the final, free remedy is available. When you receive the second notice, please contact your authorized Thomas Built Buses dealer to schedule the Recall for your vehicle. If you do not own the vehicle that corresponds to the identification number(s) which appears on the Recall Notification, please return the notification to the Warranty Campaigns Department with any information you can furnish that will assist us in locating the present owner. If you have leased this vehicle, Federal law requires that you forward this notice to the lessee within 10 days. If you are a subsequent stage manufacturer, Federal law requires that you forward this notice to your distributors and retail outlets within five working days. When 5/8 inch of aesthetic foam was added to seat barriers for styling purposes, FMVSS 222 changed the conditions of the seat barrier test with which the prior seat complied. The amount of energy absorbed by the seat barrier under the revised test did not meet the specification standard 5.2 of 452 joules / person within the first 356 mm of deflection. The issue was that a purely aesthetic piece of foam changed the technicalities of how structural testing is performed, resulting in barrier with the foam not passing the amended FMVSS 222, S5.2.3 requirement. On January 16, 2020, DTNA submitted a petition seeking exemption from the notification and remedy requirements of 49 U.S.C. 30118 (d) and 49 C.F.R. Part 556 on the basis that a noncompliance with FMVSS 222 is inconsequential as it relates to motor vehicle safety. On or about August 4, 2022, DTNA received notice from NHTSA that petition was not approved. On August 10 2022, DTNA filed the amended DIR to begin the process of recalling those Barriers upon receiving the notification of NHTSAโs determination regarding the petition.
