As a result, the vehicle failed to comply with the requirements of FMVSS 136 – Electronic Stability Control Systems. If a noncompliance, provide the applicable FMVSS: FMVSS 136 Describe the safety risk: In an emergency maneuver a vehicle that does not comply with the FMVSS 136 requirements may have an increased risk of a crash. Identify any warning which can precede or occur: If applicable, identify the manufacture of the defective or noncompliant component. Involved Components Component Name: Air Disc Brake System and ESC system Component Description: Component Part Number: Chronology of Defect / Noncompliance Determination Provide the chronology of events leading up to the defect decision or test data for the noncompliance decision. In August 2021, Thomas Built Buses began an internal review FMVSS 136 ESC requirements. From September 2021 through October 2021, staff conducted a thorough assessment of all buses that were thought to be at risk of having noncompliances. This assessment identified 1 bus that was manufactured without an ESC system as required by FMVSS 136 ESC. Promptly upon determining the noncompliance, in November 2021 DTNA decided to conduct a noncompliance recall. Identify the Remedy Describe the defect/noncompliance remedy program, including the manufacture’s plan for reimbursement. The remedy is to install an electronic stability control system. Repairs will be made by Daimler Trucks North America authorized service facilities. Details of the reimbursement plan will be included in the owner’s notification letter. Identify the Recall Schedule Describe the recall schedule for notifications.: Customer notification will be made by first class mail using Daimler Trucks North America records to determine the customers affected.
