Production Dates : JUL 19, 2012 – NOV 29, 2022 VIN Range 1 : Begin : NR End : NR Not sequential Description of Noncompliance : Description of the Noncompliance : Vehicles equipped with certain configuration combinations of driver seats and driver seat belts may have an improper seat belt retractive force under certain driver seat adjustment conditions creating an interference of the driver seat belt between the seat back panel and the driver’s rear partition. This may cause a FMVSS 209 S4.3(j)((2)(i)(A) regulatory non-compliance. FMVSS 1 : 209 – Seat belt assemblies FMVSS 2 : NR Description of the Safety Risk : Under certain conditions, non-compliant seat belt may increase the risk of injury in case of a crash. Nova Bus has not received any property damage claim, and neither notice or claim of injury or death associated with this defect. Therefore, we consider this as a proactive measure to protect the public from the potential safety risk associated with this defect. Description of the Cause : The interference analysis during the integration of certain seats did not capture this issue. Nova Bus has not received any property damage claim, and neither notice or claim of injury or death associated with this defect. No certification testing has been performed for this situation. Only trials on vehicles in production and in service have been performed during the Product Safety Working Group analysis period. Description of Remedy : Description of Remedy Program : Nova Bus will release a service document to limit more the recline angle of the seat back rest or add a spacer on the driver’s rear partition depeding on the seat configuration. All costs associated with this corrective measure will be covered by Nova Bus. Pre-notification remedies will be addressed using the Nova Bus general reimbursement plan on file with NHTSA. How Remedy Component Differs from Recalled Component : The affected configuration combinations of driver seats and driver seat belts will now be more limited for the recline angle of the seat back rest and certain other configuration combinations of driver seats and driver seat belts will now have a spacer installed on the driver’s rear partition. Identify How/When Recall Condition was Corrected in Production : Certain configuration combinations of driver seats and driver seat belts will be retrofitted in producion before delivery with a bracket limiting more the recline angle of the seat back rest and certain other configuration combinations of driver seats and driver seat belts will be retroffited in production before delivery with a spacer installed on the driver’s rear partition.
