New Flyer
of America, Inc. (New Flyer
) is recalling certain 2021-2023 XD35, 2022-2023 XD40, XD60, XN35, XN60, 2022 XDE35, and 2021-2022 XE40 transit buses. The Gross Axle Weight Rating (GAWR) and Gross Vehicle Weight Rating (GVWR) listed on the certification labels are incorrect, which can allow the vehicle to be overloaded. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard number 120, “Wheels and Rims – Other than Passenger Cars.”
Remedy
New Flyer
will provide and/or install new labels, free of charge. Owner notification letters are expected to be mailed November 13, 2023. Owners may contact New Flyer

SUBJECT:
Incorrect GVWR on Vin decal. Replace affected protion of VIN decal.
ISSUE:
Incorrect data was provided to the production clerk responsible for VIN decal creation. The GVWR is incorrect.
SUMMARY:
A new portion of the VIN decal will be created with the correct GVWR on it. This will be affixed on top of the incorrect information on the existing decal.
Chronology :
Late September 2023, engineering advised of a possible discrepancy in the stated GAWR/GVWR shown on certain Certification labels required under Part 567.
Additional review into mid-October confirmed a change of load ratings from a tire supplier was not captured by our documentation, causing certain combinations of tires and wheel selections to be less than that stated on the 567 label, in nonconformance with 571.120 S5.1.2.
October 16, New Flyer
’s Safety Committee convened and determined a non-conformance existed, resulting with the filing of this 573 report.
