Fisker
Group Inc (Fisker
) is recalling all 2023 Ocean vehicles. The instrument panel displays the incorrect font size of the Brake, Park, and Antilock Brake System (ABS) warning lights, and displays certain warning lights in amber instead of red. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard numbers 135, “Light Vehicle Brake Systems” and 101, “Controls and Displays.” Additionally, multiple warning lights fail to illuminate during the ignition cycle bulb check, failing to comply with the requirements of FMVSS 138 and 208.
Remedy
Fisker
will release an over-the-air (OTA) software update, free of charge. Owner notification letters are expected to be mailed June 30, 2024. Owners may contact Fisker

Ocean models produced in 2023 (totaling 11,201) will require this OTA SW update.
All vehicles produced in 2023 will have an OTA update to address the non-compliance recall items:
1) Increase in font height required (BRAKE, PARK, ABS)
2) Change in telltale color (BRAKE)
3) Brake lining telltale illumination
4) Telltales required at bulb check (FLAT TIRE, PASSENGER AIRBAG OFF)

On February 12, 2024, NHTSA staff contacted Fisker
regarding the cluster telltales’ noncompliance.
On February 14, 2024, Fisker
’s Homologation and Software Engineering Team initiated an internal investigation.
On February 14, 2024, Fisker
’s Homologation Team completed a full audit.
Between February 19 and March 8, 2024, Fisker
’s Software Team collaborated with the Design Team to address the noncompliance.
Between March 11 and March 15, 2024, the root cause analysis was completed.
On April 2, 2024, the design change was finalized.
On April 17, 2024, the bench test of the cluster was completed.
On April 26, 2024, Fisker
’s Compliance Team provided a response to NHTSA staff.
On May 15, 2024, an agreement was reached with NHTSA staff to accept the new changes.
On May 20, 2024, Fisker
’s Homologation Team completed a full audit incorporating the new changes.
On May 29, 2024, the Fisker
Decision Committee (FDC) convened to review and decided to initiate this recall on all affected vehicles. The FDC reviewed the cluster display requirements in Federal Motor Vehicle Safety Standards (FMVSS) 101 (Controls and displays), 135 (Light Vehicle Brake Systems), 138 (Tire Pressure Monitoring Systems), and 208 (Occupant Crash Protection Telltale Illumination), which mandate the illumination of certain gauges and telltales in the cluster display. is not aware of any accidents or injuries related to this issue.

The current proposed remedy is the release of the over the air new software operating system (OS) 2.1 which will update all cluster telltales to comply with the relevant FMVSS standards.
Once the vehicles in your inventory are updated with the new OS 2.1 software, they then can be released for sale.
On or before June 30, 2024, vehicle owners will be notified with a notification recall letter.

engineering identified four noncompliant cluster telltales that do not meet homologation requirements:
1. The font sizing for brake and parking cluster telltales does not comply with font size regulation requirements.
2. All brake malfunction and error telltales in the U.S.A must be red. Amber-colored telltales are permitted outside the U.S.A.
3. The brake lining telltale does not light up on the cluster screen for current production vehicles.
4. The bulb check is missing. FMVSS 1 : 101 – Control and displays FMVSS 2 : 135 – Light vehicle brake systems
Description of the Safety Risk : When cluster telltales in a vehicle are noncompliant, it poses the following
safety risks:
1. Loss of Critical Warnings: Noncompliance can lead to these warnings not being displayed or being displayed incorrectly, potentially leading drivers to overlook critical issues, resulting in accidents or breakdowns.
2. Driver Distraction: Inconsistent or faulty telltales can distract the Part 573 Safety Recall Report 24V-405 Page 2 driver as they try to interpret the information being displayed. This distraction can lead to delayed reaction times or even accidents, especially if the driver is trying to decipher false warnings or missing critical ones.
3. Misinformation: Noncompliance in cluster telltales can lead to misinformation about the vehicle’s status.
4. Decreased Vehicle Reliability: Telltales are essential for maintaining the reliability and safety of a vehicle. Noncompliance can result in undetected problems, which, if left unaddressed, can escalate into more severe issues, compromising the vehicle’s reliability and safety over time.
Overall, ensuring the compliance and proper functioning of cluster telltales is essential for vehicle safety, reliability, and legal compliance. Any deviation from compliance poses risks to both drivers and other road users.
Description of the Cause : 1. The font height of “BRAKE,” “PARK,” and “ABS” is measured to be 1.7 mm. However, FMVSS 135 requires a font height of 3.2 mm. 2. Fisker
vehicles for the U.S. market display amber telltale indicators, but FMVSS 101 requires them to be displayed in red. 3. The current flat tire and TPMS malfunction telltales do not match the certified homologation strategy. The current strategy is incomplete, as the TPMS malfunction telltale does not flash during each key cycle to indicate a TPMS malfunction condition as required by FMVSS 138. 4. The flat tire telltale and Passenger Airbag OFF telltale are missing during the bulb check at each key cycle. The flat tire telltale is required by FMVSS 138, and the Passenger Airbag OFF telltale is required by FMVSS 208 for the bulb check. Description of Remedy :
Description of Remedy Program : During routine testing, it was found that customers driving Fisker
Ocean
vehicles in the U.S. currently lack U.S. compliant operational cluster telltales. If a malfunction occurs, an amber warning light illuminates instead of the red color required by FMVSS regulations. However, the new software release operating system 2.1 will update all cluster telltales to comply with the relevant FMVSS standards. How Remedy Component Differs from Recalled Component :
Identify How/When Recall Condition was Corrected in Production : The remedy software program enables the cluster telltales to display the correct telltales to U.S.A homologation requirements.
Improved software was installed on vehicles starting May 30, 2024 at the vehicle assembly plant in Austria. Recall Schedule :
